iAY-12 THU 1236 PM TROUT WITWER & FREEMAN
. . ,
_,
Rod Kuharich
Paga 2
FAX NO, 3038324465
P, 03
The minimum target amount to be delivered to Kansas by LAVWCD is curreYttly
estimated at 3,412 acre-feet, althougi a:ina1 water accounting cannat be made until
nxnaff is over and. delivezies are complete. The AVWCD expects to acquire and
deliver the balanoe of Colorada's obligation to .ansas in 2006, and will request
another drought grant in 2006 to defray those costs,
4. Copies.af official federal and state drought declarations for the affected counties
(Bent, Crovley, Y'ueblo, Provu'ers, and Otero Caunties) are enclosed with this
Application. These declarations covez the .awer Arkansas River for the period 2000
tn 2004.
The court-mandated H-I Model calculates total Compact obligaions, but cannat
break these down by count'. As noted a,bove, Co3orado had a 3,074 acre-foot credit
ente7ing the drought, while its current replacement obligation is 6,824 acre-feet.
Colorado's total obligation would have been 9,898 acre-feet absent the pre-drought '"
cred.it that existed from 1997 to 1999. This credit more han offsets the sma.11 amount
of the T.ower Ariansas River that was not under drought declarations from 2000 to
2004 (Pueblo County', 2000). Thus, a11 of the water Colarado currently owes Kansas
— the purpose of this Application — is a result of drought in co.nties under federal or
state drou.t declarations.
5, Attached is a line-item budget showing a11 pmjected and actual expeditures,
including in-kind support.
6. A copy of the LAVWCD's current annual budget and 2004 fiAancial statement is
enclosed.
7. The LA'VV'CD is a political subdivision of the State of Colorado, ozganized in 2002
pursuant to article 45 oftitle 37, Colorado Revised Statutes. FYndings and lecree,
Case lvo. 02CV793 (Puebla Cunty District Court, 2002). A list of the LAVWCb'S
current Board of Directors is enclased.
The T.AVWCD was established "fr the purposes nf conservation of th water
resources within the District, [and] for their greatest beneficial use. .." Findings and
.lecree. Without timelyeplacement of Colorado's water obligation to Kansas,
groundwatez withdrawals within the LAVWCD will be curtailed under the State
EngineeT's Basin ltules, which vcrill interfere with the greatest beneficial use of water
in the Lower Arkansas Hasin. The LA'V"VV'CD requests this grant in order to further
the conservation and beneficial use of water within the Lower Axkansas Basin.
►ppendic 1 to Contract C1502°0 2
