� � <br />State of Colorado, Colorado Water Conservation Board <br />Contract Routing Number (CLIN #):�')� F�1.9 /J��� <br />Contract No. 150216 <br />Grant Amount: $50,000 <br />GRANT CONTRACT <br />THIS CONTRACT, dated this October 19, 2007, by and between the State of Colorado, for the use and <br />benefit of the Department of Natural Resources, Colorado Water Conservation Board, located at 1313 <br />Sherman Street, Suite 721, Denver, Colorado 80203, (the "State"), and the Republican River Water <br />Conservation District Water Activity Enterprise, located at 410 Main Street, Suite 8, Wray, Colorado 80758, <br />("Contractor" or "Grantee"). <br />FACTUAL RECITALS <br />A. Authority exists in the law and funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains available for encumbering and <br />subsequent payment of this Contract through the Colorado Financial Reporting Systems (COFRS). <br />B. Required approval, clearance and coordination have been accomplished from and with appropriate <br />agencies. <br />C. The Grantee has requested a nonreimburseable expenditure to undertake a feasibility study for a <br />Compact compliance pipeline project to assist the State of Colorado to comply with the Republican <br />River Compact compliance and to sustain water resources within the Republican River basin. The <br />CWCB has determined that the project will benefit agricultural water users, municipalities and other <br />water providers in the Republican River basin, and will assist the CWCB in its water resource <br />planning efforts. The Grantee has agreed to sponsor feasibility study which is expected to cost <br />approximately $50,000. The O�ce of the State Engineer, Division of Water Resources, State of <br />Colorado, has agreed to administer this Contract on behalf of the CWCB. <br />D. At its November 17, 2004 meeting, the CWCB approved a nonreimbursable expenditure for the <br />project to the Grantee in an amount up to $50,000. <br />E. Pursuant to Section 37-60-121(1)(b)(IV), C.R.S., the CWCB is authorized to make nonreimbursable <br />expenditures from the CWCB Construction Fund with specific authorization from the General <br />Assembly. Pursuant to Senate Bill 05-084, Section 14(1), the Colorado General Assembly authorized <br />CWCB to allocate to the Grantee an amount up to $50,000 for this feasibility study. <br />NOW THEREFORE, in consideration of and subject to the terms, conditions, provisions and limitations <br />contained in this Contract, the State and Grantee agree as follows: <br />AGREEMENT <br />1. Definitions <br />The following terms as used in this Contract shall be construed and interpreted as follows, unless the <br />context otherwise expressly requires a different construction and interpretation: <br />1.1. "Compensation" means the funds payable to Grantee by the State which are related to the Services <br />set forth in the Scope of Work set forth in Exhibit A, attached hereto and incorporated herein. <br />Page 1 of 15 <br />
