� <br />Rules and Regulations <br />e Division 2 Rules require that all groundwater diversions be augmented based on prescribed depletion rates. If the Plan does <br />meet the participants' full augmentation requirements, participants will be held responsible for adhering to the Rules and <br />curtailing groundwater diversions as necessary. <br />�the event an individual participant underestimates his/her annual groundwater diversions, and the participant has approached <br />or exceeds their estimated amount, the Division Engineer will notify AGUA immediately and until more water is found for that <br />� 11, that well will CEASE pumping. If you need more water you can fill out and sign an Excess Reserved Purchase Form <br />scribed on page 2 of this application). The Rules will be strictly enforced. <br />e total augmenta,tion water required for replacement of groundwater diversions for irrigation will be based on actual monthly <br />undwater diversions as supplied by the participants in the Plan or the electric companies, and the replacement rates required <br />by the presumptive depletions esta.blished in the Division 2 Rules. The present presumptive replacement factors established in <br />� Division 2 Rules for irrigation groundwater diversions under this plan are as follows: <br />• 30% of total acre-feet pumped (diverted) for supplemental irrigation supply (those persons that use their welUwells <br />� as a supplement to their ditch water rights). <br />50% of total acre-feet pumped (diverted) for sole source irrigation supply (those persons that don't use any ditch <br />water rights and rely totally on their welUwells). <br />� 75% of total acre-feet pumped (diverted) for sprinkler irrigation supply (those persons that use their wells strictly <br />for sprinkler irrigation). <br />ou don't find your well use above, you can call our office for your depletion factor. Those wells that fall in the <br />egories of household, commercial or municipal, etc. will have a special depletion factor determined by AGUA's <br />Engineer and approved by the Division Office based on the information submitted. A complete set of Rules and <br />gulations are available from the Division 2 Engineer's Office or on the Internet at www.state.co.us. <br />orm 13 — Groundwater Use Information Form <br />'�is form must be submitted for each well in order to be in compliance with Rule 13 of the amended Rules and <br />I�gulations. This form is provided by the Division 2 Engineer's Office and must only be completed one time, except in <br />cases of changes of ownership or other changes in the use of the well. AGUA will provide this form with the <br />�lication. If you are a new member, this must be submitted with the application. <br />Statement of Verification and Membership Agreement <br />� h participant in the AGUA plan agrees to indemnify, defend, and hold harmless the Arkansas Groundwater Users' <br />ssociation from any and all liability expenses, claims, or actions based on that participant's well diversions. <br />rtify that the foregoing information is true and correct to the best of my knowledge. I hereby authorize the power supplier <br />each well included on this form to provide power records to the Division Engineer and AGUA on a monthly basis and to <br />provide power meter and other information about my electrical service as requested by the Division Engineer. <br />�derstand that a loan has been secured from the Colora.do Water Conservation Board and an account has been established for <br />re ayment. Under the state statute creating the loan account, well users who accept the benefits of the loan must agree to cease <br />ping should they fail to pay membership dues, including water assessments. I understand that by virtue of my membership <br />� AGUA, I have accepted the benefits of this loan account. I hereby agree to cease pumping water covered by my membership <br />immediately, if I fail to make full payment of my membership dues or water fees. I understand that failure to cease pumping <br />er these circumstances may result in prompt and complete curtailment by the State Engineer of the use of my we11(s). I <br />1 eby agree to comply with any new rules or amendments to existing rules adopted by the State Engineer and approved by the <br />water court pertaining to the measurement or use of groundwater on the Arkansas River Basin. I have read the foregoing and <br />� ee to abide by its terms and all other reasonable rules and regulations of AGUA.
