Numerous AGUA members have identified their wells as the sole
source of water supply on their farms. Thus, a CWCB loan to purchase augmentation water for
AGUA's Arkansas River replacement plan will assist in maintaining the agricultural viability of
the Arkansas River valley by allowing AGUA's membership to continue to use their wells for
irrigation and provide a reliable source of water that is not subject to availability from a lessor.
Applicant obtains commitments from its members that any such member who fails to make
payments in accordance with the loan agreement shall cease pumping water.
Appendix D includes a copy of the 2003 Application and Membership agreement, wherein each
AGUA — 2003 Feasibility Study - 25 - August 15, 2003
