' <br />' <br />' <br />' (d) <br />' <br />' <br />' <br />' e) <br />' <br />' <br />, <br />' (f) <br />' <br />' <br />' <br />, (8) <br />' <br />' <br />J <br />well and increasing the augmentation water fee up to $60.00 per acre-foot of well depletion and <br />the loan assessment fee up to $7.50 per acre-foot of well depletion as needed. <br />Applicant is able to collect payment for the augmented water from its members. <br />The Certificate of Incorporation for AGUA (see Appendix A), under Purposes and Powers, <br />paragraph 1(h), allows the Corporation to "Establish schedules of charges and assessments <br />necessary to offset all costs of the Association and for the delivery of water, either directly to its <br />members or other vested water rights for the benefit of its members, or for the provision of water <br />pursuant to a plan for augmentation or substitute supply plan and to collect such water charges <br />and assessments from its members." <br />Loan will serve the needs of a broad group of users other than a specifzc user. <br />The entire membership of AGUA will benefit from the proposed ditch improvements, recharge <br />pond and purchase of the 785 shares of Excelsior Ditch, as this water right will be used to reduce <br />a portion of the total augmentation requirement and will result in less reliance upon leased water <br />rights. <br />Loan will assist in maintaining agricultural viability of the Arkansas River valley. <br />As previously mentioned, approximately 97% of AGUA's well use is for irrigation of <br />approximately 13,500 acres. Numerous AGUA members have identified their wells as the sole <br />source of water supply on their farms. Thus, a CWCB loan to purchase augmentation water for <br />AGUA's Arkansas River replacement plan will assist in maintaining the agricultural viability of <br />the Arkansas River valley by allowing AGUA's membership to continue to use their wells for <br />irrigation and provide a reliable source of water that is not subject to availability from a lessor. <br />Applicant obtains commitments from its members that any such member who fails to make <br />payments in accordance with the loan agreement shall cease pumping water. <br />Appendix D includes a copy of the 2003 Application and Membership agreement, wherein each <br />AGUA — 2003 Feasibility Study - 25 - August 15, 2003 <br />
