NOTICE OF PUBLIC RULEMAKING HEARING <br />BEFORE THE COLORADO WATER CONSERVATION BOARD <br />SUBJECT <br />This is a notice of a public rulemaking hearing before the Colorado Water Conservation Board <br />( "CWCB ") for consideration of amendments to, and possible rescission of, the Recreational in- <br />channel diversion ( "RICD ") Rules, 2 CCR 408 -3. The proposed amendments or rescission <br />would assure that the RICD Rules comport with Senate Bill 06 -37, which amends sections 37- <br />92 -102, C.R.S. and related sections. The proposed RICD Rules are attached. A redlined version <br />of the proposed rule showing changes to the current rule is posted on the CWCB's website at <br />http: / /www /cwcb.state.co.us A hard copy is available upon request to the CWCB staff (1313 <br />Sherman Street, Room 723, Denver, CO 80203; (303) 866- 3534). The CWCB may change the <br />proposed amendments as set forth herein prior to or at the rulemaking hearing and the CWCB <br />reserves the right to rescind the current rules altogether, without substituting these rules. Oral <br />presentations of the information contained in the written comments will not be necessary; <br />however, the CWCB will allow brief oral summaries of the public written comments to be made, <br />to the extent time allows, as described below. Although the CWCB strongly encourages all <br />interested persons to submit their comments in writing, a short period of time at the end of the <br />rulemaking hearing (a total of 15 minutes or less) will be reserved for oral comments by those <br />persons unable to provide the CWCB with written comments. In addition, the Board may accept <br />informal public comment in conjunction with the CWCB's September Board meeting, scheduled <br />to be in Vail, Colorado. <br />Written Comment Deadline <br />Twenty -three copies of all public written comments must be delivered to the CWCB office at <br />1313 Sherman Street, Room #723, Denver, CO 80203 by the close of business (5:00 p.m.) on <br />October 10, 2006.
