WRITTEN INSTRUCTION AND ORDER 2007 -01 <br />Written Instruction and Order Concerning the Administration of <br />RICDs <br />This Written Instruction and Order of the State Engineer ( "Instruction and <br />Order ") is issued pursuant the provisions of section 37- 92- 501(1), C.R.S. (2006). This <br />Instruction and Order specifically concerns the administration of Recreational In- channel <br />Diversions ( "RICDs "). This policy will be provided to all RICD water rights holders or <br />applicants and shall be published on the Division of Water Resource's website. <br />1.0 INTRODUCTION <br />This Instruction and Order is being introduced to address the issue of "valid calls" <br />by RICD water rights holders. When a RICD water rights holder places a call for its <br />RICD water right and no recreational use occurs on the course, the water has been wasted <br />because no beneficial use has occurred and it has prevented maximum utilization. Only <br />when uses occur may the RICD placing a valid call. A RICD call without use prevents <br />other upstream junior users from diverting that otherwise available water. <br />This Instruction and Order provides notice of the proper administration of RICDs <br />with regard to the following issues: <br />• Designation of RICD Agent <br />• Calling and Reporting. <br />• Measuring Devices <br />• Travel Time <br />• Flow rate <br />2.0 PURPOSE <br />This Instruction and Order sets forth standards and procedures for recognizing <br />and administering RICD calls with the goal of providing uniformity of administration <br />within the State of Colorado. With the prevalence of RICDs in the state, each Division <br />Engineer should apply the same standard to ensure uniform administration. <br />This Instruction and Order provides notice to RICD water rights holders and <br />would -be holders as to how the State and Division Engineers will administer RICD water <br />rights and valid calls. <br />3.0 AUTHORITY <br />
