Certainly some will argue that taking the word minimum out opens the <br />doors for higher flow amounts! <br />• The presumption against 24 hour a day flow rates and wintertime flows are <br />appropriate, and could be made even stronger. <br />• The de minimis threshold may be appropriate, and exists through regulations for <br />instream flow water rights. <br />• The 90% call threshold seems appropriate, and has been instituted, in one form or <br />another, in most of the decreed cases. In Gunnison it was much more <br />complicated. In Longmont and Silverthorne, it was tied specifically to the 90% <br />amount as in the current proposed legislation. <br />• The retained jurisdiction provision seems appropriate. <br />• If the Board is going to focus only on three specific areas where everyone agrees <br />that they have expertise, it may be appropriate to increase the weight that a water <br />court gives to those specific findings and recommendations. <br />Thank you, I am available for questions. <br />
