Ways in which SB37 would legislate notable changes to Colorado water law: <br />1. Requiring the point of diversion to be designed by a professional engineer. <br />2. Restricting a recognized beneficial use, reasonable recreation experience, to a single <br />type: kayaking only. <br />3. Creating a statutory presumption of no injury to a senior water right from junior <br />appropriations or changes of water rights. <br />4. Removing the right of a senior appropriator to place a call on junior appropriators. <br />5. Requiring retained water court jurisdiction of a new absolute appropriation; for at least <br />20 years; enabling any party during this period to file a motion asking for reconsideration <br />of whether the decreed flow rate is still necessary. <br />LM0358 <br />
