STATE OF COLORADO
Colorado Water Conservation Board
Department of Natural Resources
1313 Sherman Street, Room 721
Denver, Colorado 80203
Phone: (303) 866 -3441
FAX: (303) 866 -4474
www.cwcb.state.co.us
MEMORANDUM
TO: CWCB members
FROM: Ted Kowalski
Bill Owens
Governor
Russel George
Executive Director
Rod Kuharich
CWCB Director
DATE: January 16, 2006 Rick Brown
Acting Deputy
SUBJECT: Agenda Item No. 10. Water Supply Protection Section — Chaffee Director
County RICD Update — Case No. 2 -04CW 129.
Background
The Board held a hearing on the Chaffee County RICD in May 2005. At that hearing the Board
continued the hearing and deliberations so that the parties could continue to explore settlement
possibilities and present the settlement to the Board for its consideration, prior to having the Board issue
its findings of fact and recommendations. Subsequently, the Board has continued the hearing and
deliberations several times. The parties have made substantial progress towards settling this case, but are
not yet ready to present a settlement proposal for the Board review and comment. However, Chaffee
County requested the opportunity to update the Board on the progress to date. In addition, Chaffee
County is seeking another extension from the Board because Chaffee County expects to bring a
settlement to the Board for its consideration at the March 2006 Board meeting.
Staff Recommendation
The Staff recommends that the Board permit Chaffee County the opportunity to update the Board on the
progress towards settlement, and authorize Chaffee County and the other parties to supplement the record
up until March 9, 2006.
Flood Protection • Water Supply Planning and Finance • Stream and Lake Protection
Water Supply Protection • Conservation and Drought Planning
