5.52(B) Party Status <br />5.52(B)(i) Party status will be granted to any person who timely files an application with the <br />Board Staff. Any person filing a Notice to Contest shall be granted Party status and need not <br />apply therefor. An application for Party status must be received by April 30 . An application <br />for Party status shall set forth a brief and plain statement of the reasons for seeking Party status, <br />the contested facts, the matters which the applicant claims should be decided and a general <br />description of the data to be presented to the Board. <br />5.52(B)(ii) Only a Party may submit for the record technical evidence, technical witnesses or file <br />legal memoranda. Each Party is responsible for mailing copies of all documents submitted for <br />Board consideration to all other Parties and Contested Hearing Participants. <br />5.52(B)(iii) The Staff shall automatically be a Party in all proceedings concerning contested Staff <br />ISF recommendations. <br />5.52(B)(iv) Where a contested Staff ISF recommendation is based fully or in part on another <br />agency's recommendation, that agency shall automatically be a Party in any proceeding. <br />5.52(C) Contested Hearing Participant Status <br />5.52(C)(i) Any person who desires to participate in the process, but not as a Party, may <br />request Contested Hearing Participant status by contacting the Board Office. A person with <br />such status will receive all Party documents. (Note: This mailing list is specific to the contested <br />appropriation). Contested Hearing Participants may comment on their own behalf, but may not <br />submit for the record technical evidence, technical witnesses or legal memoranda. <br />5.52(C)(ii) The request for Contested Hearing Participant status must be received by April 30 <br />5.52(C)(iii) Staff shall notify all Parties of the list of Contested Hearing Participants prior to May <br />31S Thereafter, Parties shall mail their prehearing statements and any other documents to <br />Contested Hearing Participants. <br />5.53 Prehearing Conference <br />5.53(A) The Board will designate a Hearing Officer, who shall schedule and preside over <br />preheating conferences and assist the Parties with procedural matters. All prehearing <br />conferences will be scheduled and held before the July Board meeting. <br />
