CITY OF FORT COLLINS, IN LARIMER COUNTY THIS MATTER, having come before the Court upon the Application of the City of Fort Collins for approval of conditional surface water rights, and the Court being fully advised in the premises and having taken such testimony as is necessary, does hereby find: FINDINGS OF FACT 1. The matter before the Court is an application for conditional water rights by the City of Fort Collins ( "Fort Collins "). The Court's Findings of Fact relate to the procedural setting of the case and the facts required to be established by Fort Collins in order to obtain a decree for conditional water rights. 2. This Application was filed with the Clerk of the Water Court, Water Division No. 1, on December 31, 1986. Amendments to the Application were filed with the Clerk of the Water Court, Water Division No. 1, on June 1, 1988. 3. All notices required by law of the filing of the Application and Amendments to the Application have been fulfilled. The publication costs for such notices have been paid by the Applicant. The water rights claimed by•the Applicant are outside the boundaries of any designated ground water basin. The Court has jurisdict -Jon 'over the subject matter of this proceeding and over all parties affected hereby, whether they have appeared or not. 4. Timely Statements of Opposition were filed by the Henrylyn Irrigation District, the City of Thornton acting by and through its Utilities Board, the St. Vrain and Left Hand Water Conservancy District, the Northern Colorado Water Conservancy District, the City of :Greeley acting by and through its Water and Sewer Board, the Colorado Water Conservation Board, and the Cache i W \Frx[. \xen�n�necsEZ. ear
