Greg Peterson said that it is his intention to do so, but that there could be <br />situations where we stipulate. <br />Don Cardin moved to use option 3 (blue line) flows in filing the application. Jim <br />Cochran seconded the motion. <br />The board discussed possible flows including combining option 2 and Mark <br />Schumacher' s recommendations for higher flows during late June and July. <br />The motion failed. Dennis Steckel abstained due to a possible conflict of interest. <br />Steve Glazer moved to adopt a flow regime that follows the blue line through June <br />15 and modify it to include 1500 cfs during June 16 -30, 1100 cfs during July 1- <br />15, then drop back down to the blue line. The flows would be: May 1 -15, 570 <br />cfs; May 16 -31, 1190 cfs; June 1- 15,1460 cfs; June 16 -30, 1500 cfs; July 1 -15, <br />1100 cfs; July 16 -31, 530 cfs; August 1 -15, 460 cfs; August 16 -31, 390 cfs; <br />September 1 -15, 300 cfs; September 16 -30, 270 cfs. Diane Lothamer seconded <br />the motion. The motion carried, with Dennis Steckel abstaining due to a possible <br />conflict of interest. <br />Ken Spann moved approval of Resolution 02 -0 5, as amended and with the flow <br />amounts above inserted. Scottie Willey seconded the motion. The motion carried, <br />with Dennis Steckel abstaining due to a possible conflict of interest. <br />5c. CONSIDERATION OF REQUEST TO SUPPORT NORTHWEST COLORADO <br />COUNCIL OF GOVERNMENT' S QUALITY/ QUANTITY COMMITTEE' S REPLY BRIEF <br />ON BEHALF OF GOLDEN <br />The board discussed the possibility of filing an amicus brief in support of Golden' s <br />RICD decree. Concerns were raised regarding the fact that the board had not yet <br />seen a copy of the brief. <br />Bob Irby moved that the District not sign the brief, nor submit its name with the <br />brief and that the District is not associated with it. Diane Lothamer seconded the <br />motion. The motion carried. <br />Mark Schumacher thanked the board for filing the RICD application in a timely <br />fashion and for filing an application that will stand on its own and for taking public <br />comment. <br />4.
