Agenda Item 12 <br />July 16, 1991 <br />The staff has been approached by Hinsdale County regarding their concerns <br />over the stabilization of the outlet of Lake San Cristobal. The county has two major <br />concerns. Their first concern is to minimize the risk of flood damage to people, <br />property and roadways in the county resulting from a rapid release of water through <br />the outlet due to erosion. Their second concern is to ensure that the benefits which <br />the lake provides are maintained. A significant portion of the county's economy is <br />based on tourism, and maintaining a constant lake level is critical to the <br />tourist /recreational facilities at the lake. <br />The county has also contacted other state and federal agencies in their search <br />for assistance for the stabilization project. The U.S. Soil Conservation Service (SCS), <br />in response to the county's request for assistance, field inspected the lake's outlet and <br />prepared a brief report on their findings. A copy of the SCS report is included for <br />your information. It gives a good summary of the history of the lake, the post - <br />stabilization efforts and the SCS's findings and conclusions. <br />Hinsdale County has requested an opportunity to come before the Board and <br />discuss the need for the stabilization project and the importance of such a project to <br />the county. They would also like to explore ways in which the Board may be able to <br />assist in the outlet stabilization effort. The county believes that with the Board <br />holding a natural lake level water right, the Board may have a special interest in the <br />stabilization project. <br />Water Rights Issue <br />On December 31, 1991, POWER and J.S. Ward filed for a water storage right <br />in Lake San Cristobal with a claimed appropriation date of July 20, 1956. The <br />applicants claimed various recreational uses as well as heritage and watershed <br />protection, wildlife procreation, preservation of the natural environment and flood <br />control. At its March, 1991, meeting the Board ratified the statement of opposition <br />filed on its behalf in this case to reaffirm its position, pursuant to 37 -92- 102(3) C.R.S., <br />as being, the only entity authorized under state law to be granted a decree "for natural <br />surface water. -. Levels_ or volumes for. _ natural lakes, for any purpose. whatsoever <br />(emphasis added) ". <br />In discussions with POWER it was learned that one concern they had with the <br />Board's water right was that it appeared to be for maintaining minimum stream flows <br />rather than for maintaining a minimum lake level and volume. The staff researched <br />the court documents and did uncover a clerical error which had been made in the <br />referee's ruling.
