3. Legal description of location of dam: Left abutment of dam is located in Hinsdale <br />County, in the NEI /4NE' /4SWI/4 Section 15, Township 43 North, Range 4 West, N.M.P.M., at a point <br />approximately 2100 feet east of the west section line and 2100 feet north of the south section line of <br />said Section 15. <br />4. Source: Lake Fork of the Gunnison River. <br />5. Facts concerning appropriation: <br />(a) Appropriation for recreation and fishery initiated on June 1, 1990 by Hinsdale <br />County raising existing dam approximately 4 feet by placement of rocks and other material. <br />Additional impounded water put to beneficial use for recreation, fishery and wildlife on June 1, 1990. <br />(b) Appropriation for uses described in paragraph 7 below initiated by resolution <br />of Upper Gunnison River Water Conservancy District Board of Directors on April 28, 2003. <br />6. Amount claimed: 960 acre -feet absolute for recreation and fishery and 960 acre- feet <br />conditional for all other uses claimed claimed in paragraph 7 below. <br />7. Uses: Domestic, municipal, commercial, industrial to include mining, milling and <br />reclamation, irrigation, recreation, fishery and wildlife habitat and all other lawful beneficial uses <br />within the Upper Gunnison River Water Conservancy District directly or by augmentation or <br />exchange. <br />8. Surface area of high water line: Approximately 320 acres. <br />9. Maximum height of dam in feet: 10 feet. <br />10. Length of dam in feet: 85 feet. <br />11. Total capacity of reservoir in acre feet: 13, 545 acre -feet existing, 14,505 acre -feet <br />proposed. <br />12. Active capacity : 960 acre -feet proposed <br />13. Dead storage: Minimum Lake Level of 13,545 acre -feet <br />14.
