1 37 -92 -103. Definitions. As used in this article, unless the context <br />2 otherwise requires: <br />3 (4) 'Beneficial use" is the use of that amount of water that is <br />4 reasonable and appropriate under reasonably efficient practices to <br />5 accomplish without waste the purpose for which the appropriation is <br />6 lawfully made and, without limiting the generality of the foregoing, <br />7 includes the impoundment of water for recreational purposes, including <br />8 fishery or wildlife, OR THE DIVERSION OF WATER BY A COUNTY, <br />9 MUNICIPALITY, CITY AND COUNTY, WATER DISTRICT, WATER AND <br />10 SANITATION DISTRICT, WATER CONSERVATION DISTRICT, OR WATER <br />11 CONSERVANCY DISTRICT FOR RECREATIONAL IN- CHANNEL DIVERSION <br />12 PURPOSES. For the benefit and enjoyment of present and future <br />13 generations, "beneficial use" shall also include the appropriation by the <br />14 state of Colorado in the manner prescribed by law of such minimum <br />15 flows between specific points or levels for and on natural streams and <br />16 lakes as are required to preserve the natural environment to a reasonable <br />17 degree. <br />18 (7) "Diversion" or "divert" means removing water from its natural <br />19 course or location, or controlling water in its natural course or location, <br />20 by means of a ditch, canal, flume, reservoir, bypass, pipeline, conduit, <br />21 well, pump, or other structure or device; EXCEPT THAT ONLY A COUNTY, <br />22 MUNICIPALITY, CITY AND COUNTY, WATER DISTRICT, WATER AND <br />23 SANITATION DISTRICT, WATER CONSERVATION DISTRICT, OR WATER <br />24 CONSERVANCY DISTRICT MAY CONTROL WATER IN ITS NATURAL COURSE <br />25 ORLOCATIONFOR RECREATIONAL IN-CHANNEL DIVERSIONS EXCEPTWHERE <br />26 AN APPLICATION THEREFOR HAS BEEN FILED AND THE EVIDENTIARY <br />27 RECORD BEFORE THE WATER COURT HAS BEEN CLOSED PRIOR TO THE <br />_5_ SBOl -216 <br />
