You know is there really a need to <br />appropriate all remaining unappropriated water. The reason its 75 in February is because that is all the <br />water that is there. <br />Glen Porzak that is the amount existed on a day when the kayak course was in use, that's right. It'ran <br />actual beneficial use that was, which is was push. Now, there will times when there is a lot more than the <br />flows that existed in when those..... amounts are absolute. But again it's all in the eye of the beholder. <br />You know, what may be enough for you or may be enough for other people may not be enough for a city <br />that has a very design intent to create the biggest and the best to hold national competitions to put Golden <br />on the map as the capitol of certain recreational activities. And that w an integral component of its <br />downtown development. We will let the court deicide whether or not somehow we exceed the parameters <br />of reasonableness. But to run into court and try, and to the state legislature and try and put your arms <br />around what is reasonable, that is a very slippery slope as we heard ample testimony that that. You know <br />once you embark down that road enterprising minds are thinking of all different ways of utilizing the <br />same standards. <br />Bob Burr — Glen I would like to ask I have heard several people claim that the stream is over <br />appropriated now.. Without any recreational flows or however you want to put it. How would you <br />address that?' <br />Glen Porzak— It depends on the point of the stream that you are on. One of things that wasn't spoken <br />here is that there are a lot of downstream users who love this appropriation. And you look at the big guns <br />on Clear Creek: Thornton, Arvada, Northglenn, Farmers Reservoir & Irrigation Company. They like this <br />filing just fine. And its true that the water use downstream of there is over appropriated. Upriver there is <br />very limited exchange potential because of instream flow filings that exist on the upper regions of Clear <br />Creek. In fact Georgetown is having considerable difficulty. Golden sat down with Georgetown and <br />actually subordinated its recreational diversion to various water rights that Georgetown needed and came <br />up with some very creative solutions to solve the Loveland Ski Area's problems. We came up with some <br />very creative ways to solve Idaho Springs' and other actual water users' problems. So when it came to the <br />actual "where rubber tire meets the road" as to how you solve these future requirements of upstream water <br />users, we're able to meet those in an every situation. People need to be aware that there is a lot more going <br />with respect to Clear Creek and the City of Golden. And Golden owns 60,000 acres that is mountain <br />watershed in Clear Creek County that Clear Creek County downzoned to no development. As all as open <br />space and that's what this fight is really about. I am som ladies. This is has nothing to do with <br />recreational flow filings. This is the straw dog as Paul Zilis well knows. We've offered all kinds of <br />solutions to this problem to really protect their future water requirements with using other resources that <br />34 <br />
