Glenwood Springs Meeting <br />August 7, 2001 <br />Rod start, here to take public comment on rules that SB216 authorized CWCB to develop. <br />Before we begin, everybody introduce themselves so we know ... <br />Introductions. Then presentation. <br />Open up for comments from the audience, take into consideration in final draft rules. Anotehr <br />meeting in steamboat tonight and hearing at board's sept meeting and special meeting end of oct <br />early nov where board adopt for publication in register. Several points to make input. Do have a <br />webpage. Cwcb.state.co.us. click on line in box for info and to make comments. Will take any <br />comments in any form. Up until Sept 24. Open the meeting up. Please identify yourself so have <br />for the record. Have more lawyers than in the past. <br />David Halford: CO River District. More of a question. Will you answer or just commments? <br />CWCB is apealing. Repudiate a portion of FC decision. What protion and what affect would that <br />have if any on process talking about now for these things going to board then water court. Any <br />relationship btwn decisions? <br />RK: unsure of legal decisions. Not being a lawyer not sure how to respond to that. Rules on <br />separate track from litigation. Several areas need to beclarified by court that could affect <br />implementation of rules. Board concerned about fiing of all water inriver and judge hastings <br />ruling that world class kayak courses could command world class flows. Specific legal issues <br />can't comment and brief not drafted. <br />Fishing guy in front: Does CWCB have control over flows in river when impoundment structure. <br />Killing off invertebrates. CDOW should be min 150 max 250. Don't know how to approach this <br />when dealing with bureau of rec and fed gov. hurting river. Don't know how to go about getting <br />minimum stream flow <br />RK: earliest priority date controls. Those water rights are senior to ours and we can't place call <br />on senior rights. Might be some release requirements based on conditions of permit or EIS. Not <br />sure what those are. If senior, can't call through river. <br />Guy: even with advice of CDOW? <br />RK: right. First in time, first in right. <br />Guy: endangered fish in Grand Junction <br />RK: know that they release for 15 mi section. Don't know pattern of release, flushing spring, <br />base. <br />
