If the correct interpretation of the statutory definition of diversion is applied, Fort <br />Collins met the § 305 (9) (b) requirements by demonstrating that the appropriation can be <br />completed from the legal aspect. Only when Fort Collins applies for an absolute water <br />right will Fort Collins bear the burden of showing the actual amount of water diverted and <br />used for beneficial purposes. Until that time, Thornton's attack on Fort Collins' Power <br />Plant Diversion Dam water right claim cannot be based on the absence of diversion <br />measurements or the restricted use occurring at the Power Plant Diversion Dam. <br />IV.
