Sections 37- 92- 305(9)(a) & (b) are parallel provisions <br />which expressly prohibit a decree for either a conditional or <br />absolute water right unless the waters are intended to be or have <br />been "diverted, stored, or otherwise captured, possessed, and <br />controlled and have been applied to a beneficial use . . . ." <br />Only the Water Conservation Board is exempted from this <br />requirement. See C.R.S. S§ 37- 92- 103(3)(b); 37- 92- 305(9)(a). <br />CONCLUSION <br />Upon the facts and circumstances of this case, the <br />court below properly denied Fort Collins' application for an <br />appropriative water right in connection with the boat chute and <br />the fish ladder, and properly decreed the sought -for <br />appropriation with respect to the Nature Center Diversion Dam. <br />Accordingly, the District Court decision should be affirmed in <br />all respects and the appeal of Thornton and the cross - appeal of <br />Fort Collins be denied. <br />Dated this 10th day of June, 1991. <br />DAVIS, GRAHAM & STUBBS <br />By 21wwwsk�& <br />Gregory J.
