activity at the site of the proposed dam during the field trip was the taking of some photographs. <br />Ex.A -69; Rec.Vo1.III, p.221,1.18-25; p.222, 1.1; p.224,1.10-12. At trial, Mr. Smith further testified <br />that the decision to construct the dam was not made until some sixty to ninety days after the field <br />trip. Rec.Vo1.III, p.229, 1.6 -11. Mr. Smith acknowledged, however, in an earlier response to a <br />Thornton interrogatory, that the decision to construct the Nature Center Diversion Dam was not <br />made until two years later, on April 13, 1988. Rec.Vo1.III, p.231, 1.1 -16. Fort Collins witness, <br />Terry Robinson, testified at trial that the decision to construct the dam was made sometime in late <br />1987 or early 1988. Rec.Vol.III, p.158,1.24-25; p.159,1.1-4. <br />On December 31, 1986, Fort Collins filed an application in Water Division 1 seeking <br />conditional water rights in the amount of 55 c.fs. for "in- stream flows" within the "Fort Collins - <br />- Poudre River Recreation Corridor" ( "Recreation Corridor ") and the "Fort Collins -- Poudre River <br />Dilution Corridor" ('Dilution Corridor")' which encompass an eleven mile reach of Poudre River <br />from the Overland Trail bridge to the I -25 bridge. Appendix B. Neither the Nature Center <br />Diversion Dam nor the Power Plant Diversion Dam are referenced in the application, in fact, the <br />application expressly states that "no points of diversion are proposed." Appendix B, p.4. The date <br />of appropriation sought for the Poudre River Recreation Corridor was February 18, 1986. <br />On December 31, 1986, Fort Collins posted signs at various locations along the <br />Poudre River. Ex.A -66; Rec.Vol.III, p.216, 1.1 -7; p.217,1.23-24; p.218, 1.1 -3. These signs stated <br />Fort Collins' intent to appropriate "in- stream water rights" but made no reference whatsoever to <br />the Nature Center Diversion Dam, the Power Plant Diversion Dam, or to a plan or intent to <br />divert water.
