Case No. 94CW273 <br />City of Littleton and South Suburban <br />Park and Recreation District <br />flows in the river are less than the flow rate of the water rights herein decreed. That point <br />shall be located at or immediately above the most upsteam boatchute, which is Boat <br />Chute 10. Applicants shall be required to install such measuring device or devices to the <br />satisfaction of the State Engineer, and shall obtain concurrence of the State Engineer as to <br />the adequacy of the measuring methodology. Applicants shall verify the accuracy of any <br />river flow measurement which may result in a call under the water rights herein decreed <br />upon request of the State Engineer. <br />24. The priorities herein awarded were filed in the Water Court in the year of <br />1994 and shall be administered as having been filed in that year; and shall be junior to all <br />priorities filed in previous years. As between all rights, filed in the same calendar year, <br />priorities shall be determined by historical dates of appropriation and not affected by the <br />date of entry of ruling. <br />25. It is also ordered that the conditional right herein awarded is hereby <br />continued in full force and effect until If applicant desires to <br />maintain such conditional decree, an application for a fording of reasonable diligence <br />shall be filed on or before or a showing made on or before such <br />date that the conditional water right has become absolute water rights by reason of the <br />completion of the appropriation. <br />DATED this day of <br />2000. <br />Raymond S.
