ST ATE OF COLORADO
Colorado Water Conservation Board
Department of Natural Resources
1313 Sherman Street, Room 721
Denver, Colorado 80203
Phone: (303) 866 -3441
FAX: (303) 866 -4474
www.cwcb.state.co.us/
Bill Owens
Governor
Greg tine E.Walcher
MEMORANDUM
Executive Director
Rod Kuharich
CWCB Director
To: Colorado Water Conservation Board Members Dan McAuliffe
Deputy Director
From: Rod Kuharich, Dan McAuliffe, Dan Merriman and Ted Kowalski
Date: September 13, 2001
Re: Recreational In- Channel Diversion Rules
Pursuant to the Board's request at the July 2001 Board meeting, attached is a new version
of the Recreational In- Channel Diversion Rules ( "RICD Rules ") based on: 1) the Board's
comments at the July Board meeting; 2) public comments made at the statewide meetings; and 3)
written comments submitted by interested parties. An identical version of the RICD Rules was
faxed to each of the Board members on September 6, 2001. Also attached are copies of a
proposed timeline of the rulemaking procedure, a notice of the public rulemaking hearing that
was mailed to everyone on the Board's agenda mailing list, the official notice of the rulemaking
hearing that will be sent to the Secretary of State for publication in the Colorado Register
( "CCR "), a draft statement of basis and purpose, copies of the written comments submitted, and a
summary of the comments made at the public meetings. It should be noted that this packet
includes a number of comment letters that were received by the CWCB after the Staff faxed out
the September 6 memo. These comment letters are at the very back of the packet.
As you may recall, we will accept public comments at the upcoming Board meeting in
Cortez. In addition, the Board may choose to amend the rules based on the recently received
comment letters. Thus, the attached draft of the RICD Rules may look different than the version
that the Board authorizes the Staff to publish in the October CCR. We look forward to
discussing the current draft with the Board next week. If you have any questions or comments
that you would like to make before then, please do not hesitate to contact us.
•
Flood Control and Floodplain Management -Larry Lang, Chief • Water Project Planning and Construction- Mike Serlet, Chief •
Instream Flows and Water Rights Investigations -Dan Merriman, Chief • Interstate Streams Investigations -Randy Seaholm, Chief.
Office of Conservation Planning- William Stanton, Chief • Personnel and Budget -Susan Maul, Chief
