b Modify by adding "including existing or proposed permit terms and conditions ". May be
more useful to know what terms and conditions may be imposed as compared to simply what
permits are necessary and stage applicant is at in the permitting process. (NCWCD, CSU)
b It is not clear how information regarding other permits will assist the Board in making a
recommendation to the water court. (NWCCOG -QQ)
j. List of persons notified by the Applicant about the RICD;
k. Documentation of the effects that the RICD and the associated structures will have on
flooding, flood control and the one - hundred year flood elevations; and,
1. Information about existing or proposed gages on the affected stream necessary to
administer the water right being sought.
}► The Staff recommends the language change suggested below as a clarifying change but
otherwise recommends keeping this request for information.
Modify by changing "necessary" to "designed ". Applicant should not be determining what
gages are "necessary ". (NCWCD, CSU)
b This consideration is not relevant to the Board's determination as existing and proposed
gages will be administered by the State Engineer's Office. (NWCCOG -QQ)
9. NOTICE
Within seven days of the Application Receipt Date, the Staff shall post notice of receipt of the
application on the CWCB website. The notice shall include the name of the Applicant, the
flow amounts claimed, the water division, the name of the stream, the location of the
structures including the County, and information about how to obtain party status.
t► The Staff recommends that notice also be made to county commissioners in affected
county(ies) and to add to Board agenda mailings any pending proceedings.
b Respectfully suggested that notices of applications received by the CWCB, and notices of
proceedings regarding applications, be published, at a minimum, in the same manner as water
court resumes, and mailed by the CWCB to appropriate public entities in the basin of the
proposed diversion. (Gunnison County)
b Modify by adding " and mail notice of receipt of the application to the CWCB agenda
mailing list" after "CWCB website ". Persons do not necessarily regularly check the CWCB
website. Furthermore, the proposed additional language was contained in a prior version of
the draft rules. (NCWCD, CSU)
b Notice solely on the CWCB website is completely inadequate. At a minimum, notice should
be published in a newspaper of general circulation in County in which RICD is located.
Additionally, Board should provide notice of RICD filings in water court resume and to
CWCB's existing mailing list. (NWCCOG -QQ)
b Posting information on the CWCB's website without somehow alerting interested persons to
the fact that the information has been posted is not meaningful notice. Should reinsert
requirement that notice be mailed to the CWCB agenda mailing list. The mailed notice
should, at a minimum, alert recipients that the information has been posted on the website
and describe how those without internet access can obtain the information.
