natural environment to a reasonable degree," how does the CWCB determine the "reasonable degree"
to which the natural environment should be preserved? In answering this interrogatory, please list
each and every factor that goes into such determination and explain how each such factor is
considered.

5. In fulfilling its statutory duty, pursuant to C.R.S. § 37- 92- 102(3), to
appropriate "waters of natural streams and lakes as the board determines may be required for
minimum stream flows or for natural surface water levels or volumes for natural lakes to preserve the
natural environment to a reasonable degree," does the CWCB ever appropriate more than the
minimum flows between specific points on natural streams or more than the minimum levels for and
on natural lakes as are required to preserve the natural environment to a reasonable degree?
6. If the preceding interrogatory is answered affirmatively in whole or in part,
please explain the circumstances under which the CWCB does ever appropriate more than the
