Covell, Esq. <br />July 17, 2002 <br />Page 4 <br />average historical streamflow, and during the runoff season of May through June are only <br />44 percent to 69 percent of the average historical flow. <br />3. The Whitewater Course water right is non- consumptive and does not add to the State of <br />Colorado's consumptive use under the Colorado River Compact. Given the location of the <br />Whitewater Course, the water appropriated can be used and reused many times before it <br />leaves the state. The flow rates claimed will not preclude future upstream development <br />under the Colorado River Compact and will not affect such development any more than an <br />instream flow or hydroelectric water right. <br />4. Administration of the Whitewater Course water right can be accomplished with the existing <br />Gunnison River near Gunnison streamflow gage. The Whitewater Course water rights will <br />not injure any adjudicated water rights in the Gunnison River Basin. Any releases from <br />Taylor Park Reservoir under the 1975 Exchange Agreement would go toward satisfying the <br />Whitewater Course water right. <br />The above information summarizes my opinions concerning the water availability and <br />administration issues related to the water right application for the proposed Gunnison Whitewater <br />Course. My opinions are based on analysis of historical hydrological records and my professional <br />experience as a water resource engineer.
