Grand Ave. <br /> Bin A <br /> Montrose, CO 81401 -3146 <br /> Concerning The Application For Water Rights Of: <br /> THE UNITED STATES OF AMERICA <br /> In MONTROSE County, Colorado. COURT USE ONLY <br /> Case No.: 01 CW05 <br /> STIPULATION <br /> COME NOW the United States of America and the parties listed in Exhibit A <br /> ( "Parties "), by their undersigned counsel, and hereby stipulate and agree as follows: <br /> 1. Pursuant to this Stipulation, the Parties hereby agree to entry of a final <br /> decree in case no. 01 CW05, water division 4, in the form of the attached proposed decree <br /> dated , and attached as Exhibit B. <br /> 2. The Parties to this Stipulation shall remain parties to these proceedings for <br /> the limited purpose of ensuring that any ruling and decree entered herein is consistent with <br /> paragraph one above. Prior to submitting any ruling and decree to the Water Court, <br /> Applicant shall provide a copy of such proposed ruling and decree to counsel for the <br /> Parties for review to assure compliance with this Stipulation. <br /> 3. This stipulation is effective upon the date all parties identified in Exhibit A <br /> have executed a stipulation identical hereto. <br /> 4. The Parties hereto represent and warrant that they are authorized to bind <br /> their respective clients to the terms of this Stipulation. <br /> 5. The Parties herein agree to bear their own respective costs and attorneys' <br /> fees. This Stipulation shall be binding upon the Parties, their successors and assigns. <br /> 6. The attached proposed decree will be entered pursuant to agreement of the <br /> parties to address their interests and concerns and resolves them finally in this matter. <br /> However, because the issues addressed in the decree have not been litigated by the parties, <br />
