Actual enlargement costs have been estimated at $110 million. Substantial investments have <br /> already been made to date. <br /> The advocates of H.R. 3881 have also been very careful to consider and attempt to <br /> accommodate the needs of a variety of interests. Of course, in our western water rights system, <br /> decrees issued by our water courts will contain provisions to assure that water rights of others are <br /> not in any way injured. However, we have also attempted to accommodates the concerns of <br /> parties who don't even hold water rights. For example, the project proponents have voluntarily <br /> committed to not exercise their lawful water exchange rights at such times as the flow in the <br /> Arkansas River below the Pueblo Dam is below 100 cubic feet per second. In order to achieve <br /> this goal, Colorado Springs and other supporters of this legislation have agreed to curtail their <br /> �• L a and store it in Pueblo This 'a..._ �- .7 .� :aL <br /> ability to exchange water and. stole it ill Pueblo Reservoir. This commitment is a good-faith <br /> attempt to reach a compromise, which recognizes that such minimum flows will serve recreation, <br /> fish and environmental values. <br /> We have also inserted a provision in the bill designed to constrain additional future <br /> transbasin diversions absent consent from the basin of origin. The language of this section <br /> remains the subject of ongoing discussions, but I believe it is fair to say that all parties agree <br /> upon the objective of the legislation, i.e., the efficient utilization of existing decrees and <br /> resources. <br /> 5 <br />
