REOPERATIONS MOA <br /> EAST OF PUEBLO <br /> 2002 (prior to execution of a Reoperation Contract), pursuant to a <br /> joint funding agreement between the Enterprise and the United <br /> States Geological Survey ( "USGS "). The USGS has estimated the <br /> cost for the monitoring program in 2002 to be $164,900, with the <br /> non- federal portion of the cost -share estimated to be $97,300. <br /> 10. Participant shall be solely responsible for any change of water rights <br /> proceeding or other adjudication that may be necessary in order to store its <br /> own non - Project water in one or more of the Fry -Ark Reservoirs. <br /> B. Enterprise responsibilities: <br /> 1. The Enterprise shall work with Reclamation to establish whether <br /> authority exists under existing Federal law for the Reoperations plan and <br /> for entry into Reoperation Contracts with Reoperation Participants. <br /> Meanwhile, the Enterprise shall undertake efforts, in cooperation with the <br /> Reoperation Participants, to enact appropriate legislation to provide or <br /> confirm the necessary authority. <br /> 2. The Enterprise shall provide to Participant all estimates and accounting <br /> reasonably necessary to facilitate the payments referred to in Part V of this <br /> MOA, and shall provide to Participant an annual report documenting all <br /> costs and expenditures, and summarizing progress to date and anticipated <br /> future work. <br /> 3. The Enterprise will deposit funds received from Participant in an <br /> interest - bearing account, for use to pay implementation and development <br /> costs of Reoperations as such costs are incurred. <br /> 4. The Enterprise shall be responsible for administering the Winter Water <br /> Spill Credit as set forth in the Implementation Committee Report. <br /> 5. The Enterprise shall be responsible for facilitating the definition, <br /> implementation, and administration of the flow management program as <br /> outlined in the Implementation Committee Report, with the advice of the <br /> Storage Implementation Committee. Similarly, the Enterprise in <br /> cooperation with the USGS shall be responsible for facilitating the <br /> definition, implementation and administration of the long -term water <br /> -8- <br />
