FVA RE OPERATIONS MOB. <br /> B. Enterprise responsibilities: <br /> 1. The Enterprise shall work with Reclamation to establish whether authority <br /> exists under existing Federal law for the Reoperations plan and for entry <br /> into Reoperation Contracts with Reoperation Participants. Meanwhile, the <br /> Enterprise shall undertake efforts, in cooperation with the FVA <br /> Participants and any other Reoperation Participants, to enact appropriate <br /> legislation to provide or confirm the necessary authority. <br /> ?. The Enterprise shall provide to the FVA all estimates and accounting <br /> reasonably necessary to facilitate the payments referred to in Part V of this <br /> MOA, and shall provide to the FVA an annual report documenting all <br /> costs and expenditures, and summarizing progress to date and anticipated <br /> future work. <br /> 3. The Enterprise will deposit funds received from the FVA in an interest- <br /> bearing account, for use to pay implementation and development costs of <br /> Reoperations as such costs are incurred. <br /> 4. The Enterprise shall be responsible for administering the Winter Water <br /> Spill Credit as set forth in the Implementation Committee Report. <br /> 5. The Enterprise shall be responsible for facilitating the definition, <br /> implementation, and administration of the flow management program as <br /> outlined in the Implementation Committee Report, with the advice of the <br /> Storage Implementation Committee. Similarly, the Enterprise in <br /> ' cooperation with the USGS shall be responsible for facilitating the <br /> definition, implementation and administration of the long -term water <br /> quality monitoring program as outlined in the Implementation Committee <br /> Report, with the advice of the Storage Implementation Committee. <br /> 6. The Enterprise's undertaking and fulfillment of its responsibilities <br /> described above is dependent upon its receipt of the financial contributions <br /> of the FVA and any other Reoperation Participants as set forth in this <br /> MOA. <br /> -9- <br />
