V. Payment Requirements
A. Implementation costs
1. During the implementation phase, Participant shall make payments to the
Enterprise on a quarterly basis in an amount based on Participant's share
(as defined in ¶ IV.A.2 above) of the estimated costs of work to be
performed by Reclamation and the Enterprise in the upcoming quarter.
For the first nine months of 2001, the Enterprise has funded up -front all
expenses incurred. In October 2001, the Enterprise shall bill Participant
for its proportionate share of costs for the first nine months of 2001 and
for the estimated costs of work to be performed by Reclamation and the
Enterprise in the upcoming quarter.
2. Participant shall be credited for any advance payments made but not
expended in the previous quarter, and shall be charged for its share of any
expenditures in excess of advance payments in the previous quarter.
