ENLARGEMENTS MOA <br /> GENERAL <br /> development of an. additional 15 percent of storage space over -and -above <br /> storage actually realized by the Participant to develop the Enterprise Water <br /> Management Storage space, as described in the Implementation <br /> Committee Report. <br /> 3. Participant represents and warrants that it is an "enterprise" as defined in <br /> Article X, Section 20(2)(d) of the Colorado Constitution, and that it is <br /> authorized to enter into the multiple -fiscal year financial obligations <br /> provided in this MOA, notwithstanding Article X, Section 20(4)(b) -of the <br /> Colorado Constitution. <br /> 4. Participant agrees to support the development and implementation of any <br /> of the storage components provided for in this MOA, the PSOP Report, <br /> and the Implementation Committee Report (including Reoperations); <br /> however, Participant may take any action necessary to protect its water <br /> rights, except as specifically provided herein. <br /> -10- <br />
