Lewis Entz Testimony Senate Bill 216 (Continued) <br /> Misconceptions about the bill were coming out in <br /> testimony we heard on last Thursday. <br /> 1. 216 does not ban in channel recreational <br /> water rights, such as kayak courses. <br /> 2. 216 does not eliminate the water court role in <br /> decreeing water rights, rather it streamlines the <br /> process. <br /> 3. 216 preserves the priority date for all parties <br /> that go through the CWCB process. <br /> There was testimony that if 216 is passed, all <br /> recreational activities in the ` State would cease. <br /> However, currently all of the major kayak courses in <br /> the State operate without decreed water rights and <br /> there have been no reported problems (if asked: <br /> Salida, Durango, Boulder). <br /> Joel Heath mentioned the need for these type of <br /> rights to protect the fishery- -that is CWCB's job. <br /> Other opponents were not familiar with the <br /> provisions of the bill.
