Lewis Entz Testimony Senate Bill 216 (Continued)
Misconceptions about the bill were coming out in
testimony we heard on last Thursday.
1. 216 does not ban in channel recreational
water rights, such as kayak courses.
2. 216 does not eliminate the water court role in
decreeing water rights, rather it streamlines the
process.
3. 216 preserves the priority date for all parties
that go through the CWCB process.
There was testimony that if 216 is passed, all
recreational activities in the ` State would cease.
However, currently all of the major kayak courses in
the State operate without decreed water rights and
there have been no reported problems (if asked:
Salida, Durango, Boulder).
Joel Heath mentioned the need for these type of
rights to protect the fishery- -that is CWCB's job.
Other opponents were not familiar with the
provisions of the bill. (Taylor Hawes & Steve
Bushong).
