I would look at the potential for <br /> holding these water rights for individuals and special interest groups as <br /> potentially being fraught with mischief where an attempt to develop a <br /> water right would be met with an in- stream flow filing for recreational <br /> purposes. At the other end of the spectrum, I think it also excludes the <br /> federal government from filing on these water rights. In November of <br /> last year, the Forest Service published a report on by -pass flows, <br /> saying that in addition to requiring by -pass flows, the Forest Service <br /> could also modify channel, the channel structure and claim in- stream <br /> flow filings the same as Ft. Collins and Golden had claimed. I think it <br /> results in endless litigation, is my feeling. I do think that you have <br /> elected and appointed bodies that oversee their responsibilities and <br /> they do have a constituency to respond to. <br /> Mme. Chair: Senator McElhany. <br /> Sen.
