anybody else who comes in after that, it's a lower priority. And on
Clear Creek, which is apparently what's really caused this need for this
new legislation, we've — there's lot of users and they've been
appropriating or putting the water to beneficial use for 150 years. And
you're coming in now and so when Senator Matsunaka is saying if
Georgetown or Silver Plume makes a request for some beneficial use,
could be consumptive use for more houses or something like that,
they're coming in after you have already made your request for
beneficial use. I mean, isn't that what we're talking about. Those that
are before you, who have already asked for a water right and have
been to the court before you, you're after them, you're long — they got
rights ahead of you everyday of the week. But if somebody who now
comes in and asks for beneficial use, that he apparently is worried
about.
•
Mme. Chair: Mr. Hartman.
D. Hartman: Excuse me, yes, that is correct. The water rights we're filing on Clear
Creek are very, very junior rights. Most all of the water that is coming
•
by our course right now is senior and being called by other
downstream users, be it the cities of Westminster, Arvada, Thornton,
Northglenn, all take water out of Clear Creek below Golden. So does
Coors Consolidated Mutual. All of that is way senior to ours and it
would only be someone who comes in and files a junior right, a right
that would be in time after ours that we would affect.
Man: -- once Golden agrees to it.
• Mme. Chair: Any further questions? Thank you very much, Mr. Hartman.
D. Hartman: Thank you.
Mme. Chair: The next person is Joel Heath. Welcome to the Public Policy
Committee, Joel, Mr. Heath.
Joel Heath: Thank you. My name is Joel Heath. I've Vice President of Vail
Valley Tours and Convention Bureau. The Tours & Bureau is a
marketing cooperative representing over 600 businesses. We do not
represent the ski company. We're ma and pa businesses and our
mission is to establish a year -round economy for the Vail Valley.
Originally from Boulder, Colorado, been in Vail for the last eight
years. Vail built a whitewater park this last fall. We spent over about
$200 thousand and completed on November 10 of the year 2000.
We're ready for our first run off this year. There's four points of
emphasis that I would like to speak to in opposition about Senate Bill
216. From the economic impact side, it creates a place of gathering
April 12, 2001
Page 15
