Chair: So, I'm sorry did you say you move to withdraw it. Is there objection to withdrawing that? <br /> Seeing none, the Fitzgerald floor amendment is withdrawn. Senator Entz. <br /> Senator Entz: I'd like to offer the Entz, Taylor and Fitzgerald amendment for amendment # 021. <br /> Chair: All right, would the clerk please read the Entz amendment 021? <br /> Clerk: 021 by Senator Entz, amendment proposed <br /> Senator Entz: What this does is grandfathers Vail and Breckenridge into it and they are out of the <br /> legislation and that is all it does. <br /> Chair: Is there discussion on the Entz floor amendment? . Senator Anderson. <br /> Senator Anderson: Thank you, I am probably one of the few up here, but I am going to vote no on <br /> this amendment. This whole bill was brought forward because of the rights that were being taken by <br /> Golden and to correct some of these issues, so that we still can use, have better control over water rights <br /> going into the courts. And what you are doing with this amendment is adding two more exemptions, gee <br /> lets add three more and we won't need the bill, so I am going to vote no. <br /> Chair: Senator Entz. <br /> Senator Entz: Well, this all started back, you know, when the courts ruled that Ft. Collins could <br /> get 30 cfs for a kayaking boat chute and then also in 99 Littleton got a 100 cfs and then Golden wanted up <br /> to 1000 cfs and so forth. But it, it is the case that there are about 30 of them probably that we are going to <br /> • be looking at in the near future, so its just not, it is five of them here, and um, so I'd just like to say let's <br /> vote for 021 <br /> Chair: Further discussion? Senator Anderson. <br /> Senator Anderson: Yea I just want to make clear as somebody asked me as I walked away from <br /> the mike, I am a yes on the bill but I am a no on this amendment. <br /> Chair: Is there further discussion on Entz floor amendment, 021? Seeing none, uh, Senator <br /> Taylor. <br /> Senator Taylor: Thank you Mr. Chairman, I would urge support of the 021, is it 021? So I would <br /> urge support of this amendment. <br /> Chair: If there is no further discussion of the Entz floor amendment, will take a vote. All those in <br /> favor of the Entz floor amendment please indicate by saying Aye. "Aye ". All those opposed say "no ". <br /> "NO ". The no's have it the Entz floor amendment is not passed, Fails. <br /> Senator Entz: O.k., well, we will go back. <br /> Chair: Senator Entz to the bill. <br /> Senator Entz: I move for adoption of 216. <br /> Chair: Senator Fitzgerald. <br /> Senator Fitzgerald: Lacking the Entz, Taylor, Fitzgerald amendment, I urge a no vote on 216. It <br /> • is critical to my constituents in Breckenridge and Senator Taylor's constituents in Vail that that amendment <br /> would have passed. I urge a no vote. <br /> 4 <br />
