4.7.1. Based on the foregoing and other considerations, in my opinion the
adjudication and administration of the proposed RICD water right may impair the
ability of Colorado to fully develop and place to consumptive beneficial use its .
compact entitlements.
4.7.2. Based on the foregoing and other considerations, in my opinion the
adjudication and administration of the proposed RICD water right does not promote
the maximum utilization of the waters of the state of Colorado as referenced in
C.R.S. § 37 -92 -102 (1)(a), rather such rights are often a convenient and relatively
inexpensive means to frustrate upstream development. Under the "Law of the
River" Colorado can consumptive use approximately 25% of the total flows of the
basin. RICD uses need to carefully consider this limitation and not unnecessarily
impair the remaining opportunities to consumptively use our compact entitlements.
Dated this 22 day of June 2003. •
•
•
•
17 of 17
