4.7.1. Based on the foregoing and other considerations, in my opinion the <br /> adjudication and administration of the proposed RICD water right does not promote <br /> the maximum utilization of the waters of the state of Colorado as referenced in <br /> C.R.S. § 37 -92 -102 (1)(a), rather such rights are often a convenient and relatively <br /> inexpensive means to frustrate upstream development. Under the "Law of the <br /> River" Colorado can consumptive use approximately 25% of the total flows of the <br /> basin.
