No. 021852 <br />Division 4 Courtroom 2 <br />Phone Number: (303) 312 -7352 <br />FAX Number: (303) 312-7379 <br />E -mail: david.gehlert@usdoj.gov <br />THE UNITED STATES' THIRD STATUS REPORT <br />On March 31, 2003, the Department 'of the Interior reached an agreement with the <br />Colorado Department of natural Resources ( "DNR ") under which the United States's federal <br />reserved water right for Black Canyon of the Gunnison National Park would be quantified at 300. cfs <br />and additional water would be sought for environmental and park purposes pursuant to an instream ... <br />flow water right under Colorado law.. The agreement, attached hereto, is intended to provide <br />sufficient water to protect Park resources while also accommodating the needs of the water user- <br />community.. . <br />In light of the attached agreement with the DNR, the United States is filing a motion <br />to amend its application before this court to claim 300 cfs ofwater, or natural'flow, whichever is less. <br />In addition, the United States will seek a continuation of the current stay of this litigation for an <br />additional six months to allow the process for obtaining a water right under Colorado law to proceed. <br />The stay will also allow the court to decide the motion to amend and, assuming the amendment is <br />granted, to allow the United States to distribute to the objectors a proposed stipulated decree <br />
