` _ t <br />specified reach and the North Boulder Creek /Boulder Creek specified <br />reach and the right to use water available to certain additional <br />water rights to maintain instream flows in the specified reach, the <br />North Boulder Creek specified reach and the North Boulder <br />Creek /Boulder Creek specified reach. <br />E. The amount of water to be assigned to the Board by <br />Boulder under this Second Addendum to Agreement and Assignment will <br />not exceed the amount of water that the Board finds to be necessary <br />to preserve the natural environment to a reasonable degree in the <br />North Boulder Creek specified reach and in the North Boulder <br />Creek /Boulder Creek specified reach. <br />F. The use of the water to be assigned to the Board for <br />instream flow purposes hereunder will require water court approval <br />of various changes of water rights. <br />ASSIGNMENT OF RIGHTS TO USE WATER <br />1. Subject to such rights as are reserved by Boulder <br />pursuant to 4, 5 and 7 below and further subject to the <br />provisions of paragraphs 13 through 23 of the July 20, 1990 <br />Agreement, Boulder hereby assigns to the Board the following rights <br />to use water to be used by the Board to maintain instream flows not <br />exceeding 0.5 cfs in the North Boulder Creek specified reach: <br />a. The right to use water available to the conveyed <br />water rights, alone or in combination with other water listed in <br />this paragraph 1; and <br />b. The right to use water stored in Silver Lake <br />Reservoir in such amount as .'may be necessary, alone or in <br />combination with other water listed in this paragraph 1, to <br />maintain a stream flow not exceeding 0.5 cfs in North Boulder Creek <br />at the Silver Lake Diversion Structure ( "Silver Lake water "). <br />Boulder shall release such water from Silver Lake for the Board's <br />benefit at rates not to exceed 0.5 cfs and only to the extent <br />required to achieve flows not exceeding a total, from all sources, <br />of 0.5 cfs at the Silver Lake Diversion Structur North Boulder <br />Creek. <br />2. Subject to such rights as are reserved by Boulder <br />pursuant to paragraphs 4, 5 and 7 below and further subject to the <br />provisions of paragraphs 13 through 23 of the July 20, 1990 <br />Agreement, Boulder hereby assigns to the Board the following rights <br />to use water to be used by the Board to maintain instream flows in <br />the North Boulder Creek /Boulder Creek specified reach not exceeding <br />the lesser of 1.5 cfs!or the stream flow immediately above_ Lakewood <br />Inlet: <br />2 <br />
