Existing Water Right Information <br />Staff has analyzed the water rights tabulation and consulted with the Division Engineer to <br />identify any potential water availability problems. There are no decreed surface diversions <br />within this reach of river. Based on this analysis, staff has determined that water is available for <br />appropriation on the Gunnison River, from the USGS Gage #09128000 located below the <br />Gunnison Diversion Dam to the confluence with the North Fork of the Gunnison River, to <br />preserve the natural environment to a reasonable degree without limiting or foreclosing the <br />exercise of valid existing water rights. <br />CWCB Staff's Instream Flow Recommendation <br />Staff recommends the Board form its intent to appropriate on the following stream reach: <br />Segment USGS Gage #09128000 to North Fork Gunnison River <br />Upper Terminus: USGS Gage #09128000 at <br />(Latitude 38° 31' 45 ") (Longitude 107° 38' 54 ") <br />UTM = 42 67 632N 13 2 69 175 E <br />NE NW S10 T49N R7W NMPM <br />1900' East of West Section Line 1100' South of North Section Line <br />Lower Terminus: North Fork Gunnison River <br />(Latitude 38° 46' 58 ") (Longitude 107 50' 09 ") <br />UTM = 42 96 277N 13 2 53 652E <br />NW NW S6 T15S R93W 6PM <br />100' East of West Section Line 1070' South of North Section Line <br />Counties: Montrose & Delta <br />Length: 28.9 miles <br />USGS Quad(s): Grizzly Ridge, Red Rock Canyon, Black Ridge, Lazear <br />Flow Recommendation: <br />• Time Period: May 1 St — July 31 <br />• Flow Amount: If Blue Mesa is projected to fill and spill by July 31 in any given year, <br />the amount of the instream flow will be the flow amount above that which satisfies <br />present and future obligations of the Aspinall Unit. This instream flow water right shall <br />not be exercised in a manner that interferes with Aspinall Unit operations. <br />In addition, Staff recommends: <br />That, in its water right application and decree, the Board recognize the senior water right of the <br />Aspinall Unit for flood control purposes to ensure that this instream flow water right will not <br />interfere with the BR operations for flood control purposes. <br />Gunnison River ISF RPT vldoc <br />-5- <br />
