We met with Kevin Averich this morning and he acknowledged that he is in
breach of our loan contract by collateralizing the water shares. His solution is to completely pay off the loan as well as
to give the CWCB additional collateral for the loan in the interim. Obviously, this puts the CWCB in the best position.
I spoke with my boss and our attorney about the possibility of Bullseye Feeders assuming the loan, and our attorney
came to the conclusion that we cannot assign over the indebtedness to an entity such as yours that is in bankruptcy
protection. I realize that this puts you in a difficult position. When you have moved out of bankruptcy you can certainly
come talk to us about a new loan for a water project if it is still in your plans.
Best regards,
Vaughn McWilliams
Colorado Water Conservation Board (CWCB)
Water Supply Planning and Finance Section
1580 Logan Street, Suite 600
Denver, CO 80203
Phone: (303) 866-3441 ext. 3227
Fax: (303) 894-2578
vauhn.mcwilliams@state.co.us
www.cwcb.state.co.us
From: Kevin Lamb [mailto:kevin@bullseyefeed.com]
Sent: Wednesday, January 20, 2010 10:18 AM
To: McWilliams, Vaughn
Subject: FW: Water Contracts
Kevin Lamb
(480) 797-2921 Cell
(480) 987-9600 Office
(480) 987-9830 Fax
K LAMB _EARTHLINK.NET
From: Lynn LeSueur [mailto:lynn@bullseyefeed.com]
Sent: Wednesday, January 20, 2010 9:25 AM
To: kevin@bullseyefeed.com
Subject: Water Contracts
