STIPULATION
CONCERNING THE APPLICATIONS FOR WATER RIGHTS OF THE CITY OF
ASPEN AND THE COLORADO WATER CONSERVATION BOARD, IN PITKIN
COUNTY
COME NOW the Objectors Hugh Goodrich, Priscilla Goodrich
Rea and the Bank of the Southwest and Marian Neal Lyeth, Co-
trustees, and the Applicants the City of Aspen, and the
Colorado Water Conservation Board by and through their attor-
neys and stipulate as follows:
1. The City of Aspen will not exercise the rights
represented b
y awarded herein for minimum stream
flow to prevent the Objectors from diverting water which the
Overflow and Loughran Ditches would have been entitled to
divert in the absence of the decree awarded herein. The
Overflow Ditch referred to herein has an adjudication date of
October 24, 1952 and an appropriation date of June 19, 1947;
the Loughran Ditch referred to herein has an adjudication
date of October 24, 1952 and an appropriation date of June
17, 1947.
2. Upon the inclusion of the terms of this Stipulation
into a decree of this court, these Objectors will dismiss
their statements of opposition and entry of appearance.
