CRS 1973, and shall, at the same time, to the uu imum extent <br />legally practical, preserve the historic consumptive use for <br />allocation to other purposes in the Roaring Fork or Colorado <br />River Basins at the discretion of the Division and the Board <br />after the exchange is complete. <br />b. The Decree sought by the Board and the Forest Service <br />shall allow alternative uses without precluding their originally <br />decreed use by the Forest Service should the land exchange fail <br />to materialize. The Forest Service would notify the Board and the <br />State Engineer in writing thirty (30) days before the water rights <br />could revert to their original use. The option of the Forest <br />Service to change the use of these water rights terminates at the <br />time the land exchange is complete. <br />c. The Forest Service may withdraw the Application at <br />any time it determines that the water rights set forth in the <br />attached exhibit will be subjected to adverse conditions of use <br />or administration. <br />3. By this memorandum, the Board and the Division acquire <br />no interest in, nor rights to the use of, the water rights, other <br />than for instream'flows, except with the permission of the Forest <br />Service until such time as a land exchange or appropriate trans- <br />action between the Division and the Forest Service has been <br />consummated. <br />4. The interest of the Forest. Service in the water rights <br />described in the attached exhibit shall terminate at the time the <br />land exchange or appropriate transaction is completed. <br />
