City of Boulder and <br />Colorado Water Conservation Board <br />Case No. 90CW193 <br />Page 5 <br />1.8 cfs were changed to allow use by Boulder in its municipal water <br />supply system. <br />C. The decreed points of diversion for the subject <br />1.8 cfs of the Harden Ditch water right are Lakewood Pipeline, <br />Silver Lake Pipeline and Barker Pipeline, described below in <br />paragraph 3.2. <br />2.4 McCarty Ditch: <br />A. The McCarty Ditch was decreed a water right for <br />5 cfs for irrigation use, with an appropriation date of June 1, <br />1862, by the District Court in and for Boulder County on June 2, <br />1882. 1.56 cfs of the originally decreed 5 cfs were abandoned by <br />Boulder pursuant to the decree in Case Nos. W -7569, W-7570 and <br />W- 8520 -77 entered by the District Court, Water Division No. 1, on <br />May 31, 1989. <br />B. 295 shares (0.655 cfs) of the McCarty Ditch Company <br />are the subject of this application. 293 of these 295 shares were <br />also the subject of the decree entered by the District Court, Water <br />Division No. 1 on May 31, 1989 in Case Nos. W -7569, W -7570 and <br />W- 8520 -77. By that decree, the point of diversion and type and <br />place of use of those 293 shares were changed to allow use by <br />Boulder in its municipal water supply system. The remaining two of <br />the subject 295 shares have not previously' been changed from their <br />originally decreed irrigation use. <br />C. The originally decreed point of diversion of the <br />McCarty Ditch was on the north bank of Boulder Creek in the SW' SW'k <br />of Section 30, Township 1 North, Range 70 West of the 6th P.M.; the <br />location of the actual point of diversion is on the north bank of <br />Boulder Creek approximately 875 feet east and 125 feet north of the <br />SW corner of Section 30, Township 1 North, Range 70 West of the 6th <br />P.M. The currently decreed points of diversion for the 293 shares <br />that were the subject of the decree in Case Nos. W -7569, W -7570 and <br />W- 8520 -77 are Lakewood Pipeline, Silver Lake__,P_ipeline and Barker <br />Pipeline, descri1541 in paragraph 3.2. <br />i.5 Smith and Goss Ditch: <br />A. The Smith and Goss Ditch was decreed a water right <br />for 44.3 cfs for irrigation use, with an appropriation date of <br />November 15, 1859, by the District Court in and for Boulder County <br />on June 2, 1882. 14.5814 cfs of the originally decreed 44.3 cfs <br />were abandoned by Boulder pursuant to the decree in Case Nos. <br />W -7569, W -7570 and W- 8520 -77 entered by the District Court, Water <br />Division No. 1, on May 31, 1989.
