4. That the major source of flow in Gageby Creek is <br />return flow from Fort Lyon Canal. <br />5. That an informal hearing on this matter was held before <br />the undersigned Water Referee, on March 9, 1976, at 308 Judicial <br />Building, Pueblo, Colorado, and that those present were as <br />follows: David W. Robbins, First Assistant Attorney General, <br />for the Applicant; Duane B. Helton, P.F.., for the Applicant; and <br />Charles J. Beise, Attorney at Law, for the Objector. <br />6. That at the close of said hearing it was agreed by the <br />attorneys present to file a stipulation concerning certain <br />wording to be inserted into any decree which might be awarded <br />herein. <br />7. That such a Stipulation was filed on April 2, 1976. <br />0. That Applicant had filed on March 19, 1976, Supplemental <br />Facts having to do with a more specific legal description of the <br />location of Gageby Creel:. <br />9.
