DIVISION OF WATER RESOURCES <br />Mr. Tracy Kester — Smith Dam <br />June l, 2009 <br />Page 2 of 2 <br />If ��ou ��•ish to use the full storage capacity of the reservoir, you must first perform repairs as <br />described in the inspection report. For this Large, Significant Hazard dam, plans and specitications <br />for the rehabilitation of the upstream slope must be prepared by a Professional Engineer registered <br />in Colorado, and must be submitted to this office for review and approval prior to construction, per <br />Rule 6 of the State of Colorado's Rules and Regulations f'or Dam Sufety and Dam Construction, <br />Junua�y� 1, ?UO�. <br />In addition to the specific issues cited above, other safety concerns have been identified in recent <br />inspection reports. Of note, these items include operational problems with the upstream outlet slide <br />gate. It is my understanding that you intend to empty the reservoir in the fall of 2009 to address the <br />outlet deficiencies. At such time, an internal inspection of the outlet conduit will be required prior to <br />removal of the Storage Restriction. <br />Upon completion of the necessary work, a final inspection will be made to determine if the work is <br />satisfactory. If the work is deemed satisfactory, and there are no additional outstanding safety <br />concerns, then the storage restriction will be lifted at that time. <br />By copy of this letter, the Division Engineer is directed to enforce this restriction, but the primary <br />responsibility is yours in accordance with Section 37-87-107, C.R.S. (1991 Repl. Vol.).
