� � <br />be selected by the Contractor through competitive public <br />biddinq. The State must appcove in writinq all contracts <br />befote they can become effective. <br />3. Cause construction of the p=oject to be completed <br />within three (3) years of the date of this contract, in <br />accordance with the project plans and specifications and any <br />necessary modification(s) theteof approved by the State. This <br />time may be extended by the State in wciting if such time is <br />insufficient because of acts of God or other acts or <br />circumstances beyond the contcol of the Conttactor. The <br />Contcactor must produce documented justification of any such <br />acts or circumstances. <br />4. Requi=e all Construction Firms and their subcontractore <br />to indemnify the State and the Contractor aqainst all liability <br />and loss, and against all claims and actions based upon or <br />arisinq out of damage ot injucy, includinq death, to persons or <br />property, caused by any acts or omissions of those parties or <br />sustained in connection with the performance of any contract <br />related to the pLOject or by conditions created thereby, or <br />based upon any violation of any statute, ordinance, or <br />regulation, and the defense of any such claims oL actions. <br />5. Require all ConstLUCtion Fitms and their subcontrac- <br />tors to maintain durinq the term of their contracts for project <br />construction the followinq: <br />a. WoLkmen's compensation and employers' liability <br />insurance in the required statutory amounts. <br />b. Automobile liabil.ity i ance for all vehicles, <br />and comprehensive q 1 ility insutance, both ia <br />at least the follow� s: <br />(1) Fot any injury �o�►��on�in any single <br />occurcence, m�f��.� Hundred Thousand <br />Dolla=s ($SOU��. <br />(2) For any injury to two or more pereons in any <br />sinqle occutrence, the sum of One Million Dolla=e <br />($1,000,000). ' <br />(3) Fot any damaqe to property, the sum of Four <br />Hundred Thoueand Dollats ($400,000) fo= each <br />occu=rence. <br />Said qeneral liability insurance shall name the <br />Contractor and the State as co-insureds. No paymeats <br />shall be made to the ContLactor under this contract <br />unless copies of current certificates of all such <br />insurance have been obtained by the Contractor and <br />filed with the State. <br />6. Permit periodic inspection of construction by <br />authocized representatives of the State durinq and after <br />construction. <br />7. Without expenea to the Stai.z, rpar.aqe, oparat�, and <br />maintain the pcoject continuously in an efficient and <br />economical manner, and assume all leqa2 liability for svch <br />manaqement, opetation, and maintenance. The ContractoL agrees <br />to indemnify and hold the State harmless from any liability <br />incucred by the State ae a tesult of the State's interest in <br />the project facilities and any other property identified in <br />paraqLaph A.14. below. The Contracto= shall maintain <br />comprehensive qeneral liability insurartce coverinq the <br />management, ope=ation, and maintenance of the project from the <br />time it accepts the constructed project as substantially <br />Paqe 2 of 10 Paqes <br />
