<br />(S) The contractor will include the prov�sions of paragraph (1) through (8) in every sulrconVact and
<br />subcontractor purchase order unless exemp[ed by rules, regulauons. or orders issued pursuant to
<br />Execuuve Order, Equal Opportumry and Affirtnanve Acuon of Apnl 16. 1975, so that such provisions
<br />will be bind�ng upon each subcontractor or vendor. The contractor will take such act�on with respect to
<br />any sut>contracung or purchase order as the contracung aeency may direct, as a means o! enforcing
<br />such provisions, mcludme sancuons for non-compliance; prov�ded, however, that m the event the con-
<br />tractor becomes mvolved m, or �s threatened wi[h, liugauon wrth the subconcractor or vendor as a result
<br />of such direcuon by the contracnng agency, the contractor may request the State of Colorado to enter
<br />mto such hhgauon to pro[ect the mterest of the S[ate of Colorado.
<br />COLORADO LABOR PREFERENCE
<br />6 a. Provisions of 5-17-101 & 102. CRS for preference of Colorado labor are applicable to this contract if public
<br />works with�n the State are undertaken hereunder and are financed in whole or m part by State funds.
<br />b. When a construction contracc for a public pro�ect is to be awarded to a bidder, a resident bidder shall be
<br />allowed a preference against a non-res�dent bidder from a stace or fore�gn counvy equal to the preference given or
<br />required by the state or fore�gn country m which the non-resident bidder is a residen�. If it is determined by the
<br />ofiicer responsible for awarding the bid that compLance with th�s subsect�on .06 may cause denial of federal funds
<br />which would otherwise be available or would otherwise be inconsistent wrth reqwrements of federal law, this sub-
<br />secuon shail be suspended, but oniy to the extend necessary to prevent denial of the moneys or to eLminate the
<br />mconsistency with federal requ�rements (sect�on 8-19-101 and 102, CRS).
<br />GENERAL
<br />7. The laws of the State of Colorado and rules and regulations �ssued pursuant thereto shall be applied in the
<br />mterpretation, execuuon and enforcement of this contract. Any prov�sion of this contract whether or not incor-
<br />porated herein by reference which provides for arbitration by any extra.iudicial body or person or which is otherv
<br />wise �n contlict w�th said laws, rules and regulauons shall be considered null and void. Nothmg contamed in any
<br />provis�on mcorporated herem by reference which purports to negate this or any other special provision m whole or
<br />in part shall be valid or enforceable or available in any acti whether by way of complaint, defense or other-
<br />w�se. Any provision rendered null and vo�d by t u t provision will not mvalidate the remainder of
<br />this contract to the extent that the convact is ion.
<br />8. At all times during the performance of this Conva � tr or shall strictly adhere to all applicable
<br />federal and state laws, rules and regulations t v o�� fter be established.
<br />9 The sienatories hereto aver that they a r IS-8-301, et. seq., (Bribery and Cortupt Influences)
<br />and 18-8-401, et. seq., (Abuse of Public OtF , RS 1975 Replacement Vol., a�'d that no violauon of such pro-
