0 0 2. The name of stream involved: Little Cottonwood Creek (instream flow) 3. The source of the water is: Little Cottonwood Creek of Fortification Creek of the Yampa River 4. Legal description of the stream segment through which an instream flow is claimed: a. The natural stream channel from the headwaters in the vicinity of latitude 40° 46' 35.77"N and longitude 107° 24' 11.2"W as the upstream terminus and extending to the inlet of Freeman Reservoir at latitude 40° 45' 54.52"N and longitude 107° 25' 20.93"W as the downstream terminus, being a distance of approximately 1.45 miles. This segment can be located on the Freeman Reservoir U.S.G.S. quadrangle. b. For administrative purposes only: Upper Terminus = NE SW S32 T10N R89W 6`" PM 1467' North of the South Section Line, 2221' East of the West Section Line UTM North: 4516736.8 UTM East: 297204.9 Lower Terminus = NE SW S6 T9N R89W 6'" PM 2447' North of the South Section Line, 1675' East of the West Section Line UTM North: 4515509.6 UTM East: 295535.1 5. Use of the water: Instream flow to preserve the natural environment to a reasonable degree. 6. Date of appropriation: The water was first applied to the above beneficial use before January 23, 2008. The appropriation was completed on January 23, 2008 by the action of the Colorado Water Conservation Board under the provisions of C.R.S. § § 37-92- 102(3) and 37-92-103(3),(4) and (10). 7. Amount of water claimed (ABSOLUTE): Instream flow of 0.7 cfs (April 1 - June 30). THE WATER REFEREE RULES: The application is granted and a decree (ABSOLUTE) in the amount of 0.7 cfs (April 1-June 30) is hereby entered to preserve the natural environment to a reasonable degree in the reach of Little Cottonwood Creek between the upstream and downstream terminus points described in paragraph 4 above. The appropriation date for this water right is January 23, 2008.
