Legal description ofthe stream segment through which an instream flow is <br />claimed: <br />a. The natural stream channel from the Forest Service - BLM boundary at <br />latitude 38° 21' 53"N and longitude 1061 3' 45"W as the upstream <br />terminus and extending to the headgate of Alder Creek Ditch at latitude <br />38° 22' 3"N and longitude 106° 3' 13"W as the downstream terminus, <br />being a distance of approximately .55 miles. This segment can be <br />located on the Whale Hill U.S.G.S. quadrangle. <br />b. For administrative purposes only: <br />Upper Terminus =. <br />SWIA SWIA S35 T48N R8E New Mexico P.M. <br />0' East of the West Section Line, 522' North of the South Section Line <br />UTM North: 4246816.0 UTM East: 407167.4 <br />Lower Terminus = <br />NEIA SWI./4 S35 T48N R8E New Mexico P.M. <br />2500' East of the West Section Line, 1534' North of the South Section Line <br />UTM North: 4247105.7 UTM East: 407949.9 <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br />6. Date of initiation of appropriation: January 24, 2007 <br />7. The water was first applied to the above beneficial use on January 24, 2007, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />§ § 37-92-102(3) and 37-92-103(3), (4) and (10). <br />8.
