G. The Forest Service has no dury to inspect the permit area or to warn ofi liazards and, if the Forest Service <br />does inspect tf~e permit area, it shal! incur no additionaf duty nor liabiliry for identified or non-identified hazards. <br />This covenant may be enforced by the United States in a coutt af competentjurisdiction. . <br />V. TERMSNATIOPI, REVOCAT'ION, AND SUSPENSI01~ <br />A. General. For purposes of this permlt, "terrnlnation", "re~ocation", and "suspension" reier to the csssatian of <br />uses and privileges under the permit. <br />"Tennination" refers to ttte cessation af the permit under its own terms v~ithout the necessity for any <br />decision or action by the authorized officer. 7ermination occurs at~tomatically when, by the terms of the permit, a <br />fixed or~ag~:ed upa~ c~ndition, event, or tirne occurs. For example, the permit terrninates at expiration. <br />Terminations are not appealable. <br />"Revocatian" refers to an acfion by the authorized officer to end the permit because of noncompliance <br />with any of the prescribed terms, or for reasons in the pubiic interest. Revacations ara appeafable. <br />"Suspension" refers to a revacatian which is temporary and the priv'sleges may 6e restored upon the <br />accurrence of prescribed actions or conditions. SUSpensions are appealable. <br />B. Revocation or Suspension. The Forest Service may suspend or re~oke this permit in whoEe or part for: <br />1. Noncompliance wnth~e erTal,~~ e~, orTcaTfaws a~regu a~ns-- --~ --- ~ <br />2. iJoncompliance with the terms and conditions of this permit. <br />3. Reasons in the public interest <br />4. Abandonment or other failure of the hofder to oth~rwise ex°rcise the ~riv'sleges granted. <br />C. O~portunitv ta Take Corrective Actian. PriQr ta revocation or suspension for cause pursuant to Section V(B), <br />the autfiarrzed ofFcer shall give the holder written notice of Yhe grounds for each action and a reasonable time, not <br />to exceed 90 days, to complete the cArrecfive action prescribed by the authorfzed officer. <br />D. Removal of Impravements. Prior to abandonment of the improvements or within a reasonabfe time following <br />revocation or terminakon of this authoriza'tion, the holder shall prepare, for approval by the authorized officer, an <br />abandonment plan far the permit area, The abandonment plan shall eddress removal af improvements and <br />restotation of fhe permit area and prescribed time frames for these actions. If the halder fails to remave the <br />improvements or restore the site within the prescribed time pe~iod, they become the property of the Unifed States <br />and may be sold, destroyed or otherwise disposed of wfthout any liability to the United States. However, Ehe <br />holder shall remain liabte for all cost assaciated with fheir removal, including costs of sale and impoundment, <br />cleanup, and restoration of the site, <br />1l1. FEES <br />A. Terrninafion for Nanoavment This permit shall automabcally terminate wlthout the necessity of priar nofsce <br />when land use rental fees are 90 calendar days frorn the due date in ar~ears. <br />B. Fees for this use have been exsmpted or waived in full pursuant to 36 CFR 251.57, or revistons <br />thereto, aad d{rection in FSH 2709,11, chapter 3Q. <br />C. Pavrnent Que Date. The payment due date sl~all be the close of business on NIA of each calendar year <br />payment is due. Payments in the form of a check, draft, or money order are payable to USDA, Forest Service. <br />Payments shafl be credited on the date received by the designated Farest Service collecfion officer or deposit <br />loeation. If the due date for the fee or fee calcutation statement falls on a non-workday, the charges shall not <br />apply untiE ~he cbse of business an the next workday. <br />D. Late Pavment Interes~. Administrative Costs and Penalties Pursuant to 31 U.S.C. 37'f 7, et seq., interest shaq <br />be charged on any fee amount nat paid within 30 days from fhe date the fee ar fee calculation flnancial sfatement <br />speci~ed in this authoriza6on becomes due.
